What Are the Top Reasons Immigrants Don’t Apply for Legal Citizenship?

Many people question why immigrants do not simply come to America legally or apply for legal citizenship once inside the U.S. Here’s what you should know about barriers to citizenship for immigrants and how an experienced immigration lawyer can help.

Most Immigrants Have No Path to Citizenship

The U.S. typically allows three different types of legal immigration: for employment purposes, humanitarian protection, or family reunification. Each of these paths to citizenship is strictly regulated and has numerous eligibility requirements, most of which the large majority of immigrants will not be able to meet.

Many immigrants do not have relationships with employers or family members in America that would allow them to apply for legal citizenship.

Once In the U.S., Immigrants May Be Barred from Legal Citizenship

If an immigrant came to the U.S. without authorization, they may be barred from applying for a green card while in the country. They may also be denied access to a visa because their status cannot be adjusted as a result of entering America illegally. Asylum seekers also typically cannot apply for asylum once inside the country; they must do so upon arrival at a U.S. port.

Family Visas Are Limited

Certain eligible U.S. citizens and Lawful Permanent Residents (LPRs) can seek legal immigration status for their spouses, children, and in some cases, other immediate family members.

The citizen petitioning for the immigrant must be able to meet income requirements and must make a commitment to provide financial support to the immigrant until they secure regular income and can live independently. U.S. citizens may also be limited to how many immigrants they can sponsor wtih a family visa.

Humanitarian Protection Is Often Inaccessible to Immigrants

Each year, the United States allows a certain number of refugees to apply for U.S. citizenship. However, being admitted as a refugee in the U.S. requires immigrants to meet stringent requirements, and most will not be able to.
