TN Visa Process In Texas

The TN visa is a non-immigrant, employment-based visa. It allows U.S. employers to hire Canadian and Mexican citizens for certain professional occupations in the United States. TN professions include:

  • accountants,
  • engineers,
  • lawyers,
  • pharmacists,
  • scientists,
  • and teachers who wish to work in the United States temporarily on a non-immigrant basis.

Job Offer Requirments For TN VIsa

In order for TN visa applicants to be able to apply for TN status, they have to have job offers from U.S. employers which are considered “activities consistent with the nature of the TN nonimmigrant classification.” TN visas are available only to citizens of Canada and Mexico who seek certain types of professional occupations in Texas or any other part of the U.S. TN visas are not available to apply for work in another country, but they must qualify under the TN visa requirements in order to be considered eligible TN applicants in Texas or elsewhere in the United States.

The TN Visa qualifications required by the U.S. Department of Labor are as follows:

  • The applicant has a job offer from an employer located within the U.S., and the TN visa applicant is a Canadian or Mexican citizen;
  • The TN Visa applicant’s proposed employment must be in one of the professions listed under TN occupations, and for which a U.S. baccalaureate degree or higher is required;
  • The TN profession is on the NAFTA list of TN professions, and the TN Visa applicant has the appropriate education or experience to work in that profession;
  • The TN Visa applicant’s immigration documents must prove that he/she is qualified to be a TN Visa worker.

Filing Form I-129

To obtain TN status, TN visa applicants must file Form I-129, Petition for a Nonimmigrant Worker. The employer must complete several sections of the form including:

  • Employer’s name and address;
  • Type of business or employment;
  • Job title or proposed job position TN Visa qualifications TN visa applicants must provide TN documentation, which includes:
  1. Documents showing education and experience to meet TN Visa requirements. For example, If the TN occupation is an accountant, you should submit your TN job offer letter along with copies of your college transcripts or degree in accounting;
  2. A copy of your U.S. and Canadian and/or Mexican passport, TN visa documents, and I-94s;
  3. TN job offer letter which describes the TN qualifications and TN Visa requirements for your TN profession.

The TN NAFTA Profession List

In addition to showing that you meet the TN Visa requirements as set out by the U.S. Department of Labor, TN Visa applicants must also show that their TN profession is listed as a TN profession on the TN NAFTA professions list. The TN NAFTA list includes:

  • Accountant;
  • Architect;
  • Computer Systems Analyst;
  • Engineer;
  • Graphic Designer;
  • Hotel Manager;
  • Industrial Engineer;
  • Interior Designer;
  • Land Surveyor;
  • Lawyer (including Notary in the province of Quebec);
  • Librarian;
  • Management Consultant;
  • Mathematician (including Statistician);
  • Range Manager/Range Conservationist;
  • Research Assistant (working in a post-secondary educational institution);
  • Scientific Technician/Technologist;
  • Seminary Teacher;
  • Statistician;
  • Teacher (College/University);
  • Technical Publications Writer;

If TN visa applicants’ profession is not listed as a TN Visa NAFTA profession, TN visa applicants must show that their TN job offer for TN Visa purposes in Texas or elsewhere in the United States requires a baccalaureate degree or higher in order to work in that TN profession. TN visa applicants must also show that they have the appropriate education and/or experience to perform the duties of the TN Visa position for which TN status is requested in Texas or elsewhere in the United States.

**NOTE: In most cases, additional documentation requested by USCIS may be needed. TN Visa applicants should be prepared to submit this additional TN documentation upon request (e.g., TN state license). It is best not to wait until the application is filed with USCIS to obtain these documents if they are required for TN status in Texas or elsewhere in the United States.
